Website and account terms
Status: Draft, pending legal review. Version 1.0. This page will show an effective date and a “What changed” note once it is final. Our disclaimers page explains what a draft means.
These terms are the rules for using the Amyn website and, once we launch, an Amyn account.
Words we use
- “Amyn”, “we” and “us” mean the company that runs amynpos.com and is building the Amyn point of sale. We will publish its full legal name and address here before launch.
- “You” means the person reading this and, when you act for a business, that business too.
- “The website” means amynpos.com.
- “The point of sale” means the Amyn software that rings up sales on registers, tablets and phones, including the screen that faces customers.
- “The dashboard” means the signed-in area at amynpos.com/app where a merchant runs its account.
- “The service” means the website, the point of sale and the dashboard together.
- A “merchant” is a business with an Amyn account. Its “staff” are the people it gives a login.
- “Your customers” means the people who buy from a merchant.
- “Personal data” means any information that identifies a person or could be linked to one, such as a name, an email address or an IP address.
- “Our payment processor” means the company that will handle card payments, identity checks and payouts. We will name it here before any payment is taken.
- “The help assistant” means the automated assistant on the website. Anthropic provides it (model: Claude).
- “Our policies” means every document listed at /policies.
“Your content” means everything you put into the service, such as menus, prices, photos, logos and customer records.
Our other policies work with these terms. The privacy notice covers personal data. The cookie notice lists what we store in your browser. The acceptable use policy says what you may not do. The AI notice covers the help assistant. The responsible disclosure policy covers security research. Once you open an account, the merchant agreement and the data processing addendum apply as well.
How you accept these terms
- As a visitor. If you browse the website, join the waitlist, write to us or use the help assistant, only the parts of these terms written for visitors apply to you, and only as far as the law allows. Those parts are the sections headed “Amyn is not launched yet”, “Emails and other messages from us”, “What you may not do”, “Privacy”, “Our property and your feedback”, “Other companies’ services” and “Copyright complaints”, and the sections from “What we do and do not promise” to the end. Nothing in these terms puts account duties on a visitor.
- By creating an account. The account parts of these terms apply once you create an account. Before the account exists we show you these terms and ask you to tick a box to accept them. We record the policy version, the time, your IP address and your browser (user agent).
When you open an account for a business, you confirm that you have the authority to agree for it. The business is then the merchant, and these terms apply to it too.
Counsel: the operator’s full legal name and address must appear under “Words we use” before launch. Confirm that the tick box at account creation, and the visitor sections named above, give notice conspicuous enough to bind a visitor or an account holder to the limits, costs, disagreements and law sections below.
Who can open an account
To open an account you must be at least 18, be located in the United States, and use it to run a business rather than for personal use.
Which kinds of business can take payments through Amyn follows our payment processor’s prohibited list. Amyn adds no exclusions of its own. We will link that list here once our payment processor is named.
The service is not directed at anyone under 18. Tell us if you think we hold an account for one and we will close it.
Your account and sign-in details
- Tell us the truth about yourself and your business when you sign up, and update it when it changes.
- Keep your password and sign-in codes private, and give each staff member their own login rather than sharing one.
- You are responsible for what happens under your account until you tell us something is wrong. If you suspect misuse, email us straight away and change your password.
Amyn is not launched yet
Today the website offers a waitlist, a contact form and demos that run in your browser. The help assistant joins them once it is live.
- Nothing is on offer yet: no product, plan, price or money tool. That changes only when we publish pricing and you choose a plan.
- Features, prices and launch dates may change.
- Interest-free money tools are in development, not offered, and have no terms yet.
Fees and billing
Today nothing on the website costs money. When we publish pricing, these rules apply:
- We show every fee on our pricing page before you choose a plan.
- The software plan is month to month, with no long contract. It renews each month until you cancel, and you can cancel from the dashboard at any time.
- Fee changes come with at least 30 days’ notice, and you may close your account before one takes effect at no charge.
- We will publish how and when we charge, and what happens if a payment fails, with the pricing.
- If you think a charge is wrong, tell us as soon as you notice and we will look into it.
- Card-processing fees, payouts, holds and chargebacks are governed by our payment processor’s agreement. The merchant agreement explains them in plain words.
Taxes
You are responsible for your own taxes, including the sales tax you collect from your customers and the tax on what you earn. Any reporting of your card sales to tax authorities is governed by our payment processor’s agreement.
Emails and other messages from us
When you give us your email address or open an account, you agree that we may send notices, records and agreements by email or inside the dashboard. To receive them you need a working email address and a current web browser. You can ask us for a copy of any record. We keep two kinds of messages apart:
- Service messages, such as security alerts, fee receipts and notices of changes to these terms. You get these while you have an account. Account alerts also arrive as browser push notifications if you turn them on in the dashboard.
- Marketing messages: news and offers, sent only if you opted in. Each has an unsubscribe link, and you can turn them off in the dashboard.
We do not send text messages today. If we add them, we will ask for your consent first and tell you how to stop them.
What you may not do
Our acceptable use policy is part of these terms. In short: use the service lawfully. Do not attack, overload or scrape it. Do not copy or reverse engineer our software. Do not use it to harm, deceive or spam anyone.
Security research that follows our responsible disclosure policy is allowed. Where that policy and these terms differ on research, that policy wins.
Do not use the service where US sanctions or export rules forbid it, and do not use it on behalf of anyone on a US sanctions list.
Your content
You own your content. We claim no rights in it.
To run the service we need a narrow licence. You allow us to store, copy, back up, display and process your content for five purposes only:
- to run the service for you, including showing your content on your registers, the dashboard and customer screens;
- to keep the service secure and spot fraud or misuse;
- to support you when you ask;
- to improve the service, using aggregated statistics that identify nobody; and
- to meet our legal duties.
That is the whole licence. The merchant agreement gives the same licence for your account.
We do not use your content or your brand in our marketing unless you agree in a separate written consent, which you can withdraw. We do not sell your content, share it for advertising, or train AI models on it.
The licence lasts until you delete the content or, once your account ends, until the export window closes (see “Suspension and closing accounts”). After that it covers only backups and the records we keep for a legal duty, an open dispute or fraud prevention.
Only upload what you have the right to use, and make sure it breaks no law and no one’s rights. We do not check content before it goes live, but we may remove content that breaks these terms or the law.
Customer records are part of your content. A customer record with no activity for 24 months is flagged for your review and then anonymised, unless you choose to keep it. The data processing addendum explains how we handle your customers’ personal data.
Privacy
Our privacy notice says what personal data we collect and why. In short: we do not sell personal data, we do not share it for advertising, and we do not train AI models on merchant or customer data. To ask about your personal data, email info@amynpos.com or use the contact form. The notice explains how we check it is you and how long we take.
Our property and your feedback
The Amyn name, logo, software, website design and text belong to us or to the companies we license them from. While you follow these terms, you may use the website and the service for your business. That right is limited: it ends if you break these terms, and you cannot pass it to anyone else. It does not let you copy or resell our software.
If you send us ideas or suggestions, we may use them without owing you anything. We will not name you as their source unless you agree.
Other companies’ services
Parts of the service run on other companies’ systems: Supabase, Inc. (database, sign-in, file storage and server functions; United States) and Netlify, Inc. (hosting and the website forms). The help assistant is provided by Anthropic (model: Claude). It answers questions about Amyn and cannot see your account data. Do not type card numbers, passwords or sensitive personal data into it. Our AI notice has the details. We will name our payment processor here before any payment is taken. The privacy notice lists every company that handles personal data for us.
If you connect an outside app to your account, that company’s terms govern it. We do not control the websites we link to and are not responsible for them.
Beta features
We may let you try a feature before it is finished, labelled “beta” or “preview”. Beta features may change or disappear without notice and may have bugs, so do not make one the only way you run something essential. Our promises about your content, privacy and no AI training apply to beta features too.
Devices and updates
The point of sale needs a supported device and operating system. We will publish the list before launch, and we do not promise that the point of sale works on every device or every internet connection. Install the updates we release. An old version may stop working, and we may block a device whose operating system has been modified.
Copyright complaints
If you believe content on the service infringes your copyright, email info@amynpos.com with “Copyright complaint” in the subject line. Before launch we will register a designated copyright agent with the US Copyright Office and publish the agent’s name and contact details here. Your notice must include:
- the work you say is infringed, or a list if there are several;
- where the content is on the service, with enough detail for us to find it;
- your name, address, phone number and email address;
- a statement that you believe in good faith the use is not allowed by the copyright owner, its agent or the law;
- a statement, made under penalty of perjury, that your notice is accurate and that you are the copyright owner or are authorised to act for the owner; and
- your physical or electronic signature.
When a complete notice arrives, we remove or block the content and tell the merchant who posted it, with a copy of the notice.
If the merchant believes the content was removed by mistake or was wrongly identified, it can send us a counter-notice. A counter-notice must include: the merchant’s name, address and phone number; where the content was before we removed it; a statement under penalty of perjury that the merchant believes in good faith the content was removed by mistake or misidentification; the merchant’s agreement to the jurisdiction of the federal court for the district where its address is, and to accept service of process from the person who complained; and its physical or electronic signature.
We pass a complete counter-notice to the person who complained. Unless that person tells us within 10 business days that they have filed a court action to keep the content down, we restore it between 10 and 14 business days after we receive the counter-notice.
Repeat infringers lose their accounts.
Counsel: confirm the designated-agent registration, the notice and counter-notice requirements and the restoration timing under the US copyright safe harbour before launch.
Suspension and closing accounts
You can close your account at any time from the dashboard or by emailing us.
For a merchant account, the ending rules in the merchant agreement apply. In short: you can end it at any time. We suspend or close an account only for a reason we can name, and the merchant agreement adds no other reason:
- you break these terms or the acceptable use policy and do not fix it after we ask;
- you do not pay fees after a reminder;
- there is fraud, abuse or a real risk of harm to people or to the service;
- a law, a court, our payment processor or a card network requires it.
Where the law and safety allow, we email the account owner first, say why, and give you a chance to put things right; a closure then takes effect no sooner than 30 days after that email. Otherwise we act first and explain afterwards.
Counsel: whether Amyn should also be able to end a merchant account without a named reason on 30 days’ notice; the merchant agreement allows ending only for a named reason, and these terms follow it.
An account ends on one date, the end date. When either of us ends it with notice, the end date is the last day of the notice period. When we must close an account at once, the end date is the day we do so. You then have 60 days from the end date to export your content and reports. The merchant agreement calls this the export window. When it closes we delete or anonymise your content. The only exceptions are data we must keep for a legal duty, an open dispute or fraud prevention; we keep that data for that purpose only and delete it when the reason ends. A copy may remain in our backups until they are overwritten on their normal cycle, as the data processing addendum explains. If you owe us fees, closing the account does not cancel them.
What we do and do not promise
We work to keep the service running and accurate, but we cannot promise it never goes down, slows or has a bug. You use it in the state it is in. Keep your own backups, and check its figures before relying on them for tax or accounting. If we ever publish an uptime commitment, it will be a separate document that says exactly what it covers.
Limits on what we owe you
- We pay only for losses that a problem with the service causes directly. We do not pay for knock-on losses: for example, sales you missed while the service was down, or harm to your reputation. That holds even if you warned us such a loss could happen.
- Our total responsibility to you under these terms is capped at the fees you paid us in the 12 months before the claim arose.
- These limits apply only as far as the law allows. Nothing here limits our responsibility for fraud or for harm we cause on purpose.
Counsel: liability cap to be settled with counsel, including its effect on accounts that paid nothing and the wording state law requires.
When you cover our costs
Someone may bring a claim against us because you used the service unlawfully or broke these terms. If so, you cover the reasonable costs we face as a result, including legal fees. We will tell you promptly and work with you on it. This does not apply to claims caused by our own mistakes.
Counsel: indemnity scope to be settled with counsel, including whether it should be mutual.
Disagreements
If you have a problem, email info@amynpos.com first and we will try to sort it out within 30 days. Failing that, either of us may go to court. These terms do not require arbitration, and you keep the right to use small-claims court.
Counsel: arbitration, a class-action waiver, a time limit for claims and the fit with our payment processor’s terms to be settled with counsel.
Which law applies
These terms are governed by the laws of Amyn’s home state, which we will name here before launch, and of the United States. Courts in that state handle any dispute that goes to court, unless the law gives you the right to go elsewhere.
Counsel: governing state and venue to be settled with counsel.
Passing these terms on
You may not transfer your account or these terms without our written agreement. If you sell your business, tell us and we will help move the account to the new owner. We may transfer these terms to a company that takes over Amyn; we will tell you, and your rights stay the same.
The whole agreement
These terms, our policies at /policies, and any plan you choose are the whole agreement between you and Amyn. If they conflict, the same order applies in every policy: the merchant agreement comes first, with the data processing addendum deciding anything about personal data, and these terms come next. This order never overrides what the law requires. Where a law gives you a right or puts a duty on us, it applies whatever our documents say.
If part of these terms cannot be enforced, the rest still applies. These terms give rights to no one but you and Amyn. If we do not act on a breach straight away, we can still act on it later.
Events outside our control
Neither of us is responsible for a delay or failure caused by something outside our control. Examples are a natural disaster, a power or internet outage, or a government order. This does not excuse paying fees that are due.
How to contact us
Email info@amynpos.com or use the contact form on the website. Put “Terms” in the subject line so we can route it. If you need this document in another format, ask us; our accessibility statement explains how we help. We will publish our mailing address here before launch. Every policy, with its version and effective date, is listed at /policies.
Changes to this document
Every version of this document carries a version number, an effective date and a “What changed” note. Earlier versions stay in an archive linked from /policies. If we make a material change, we email account holders at least 30 days before it takes effect. Smaller changes, such as fixing a typo or a link, take effect when posted. This is version 1.0, and no earlier version exists.
A material change to these terms is one such as a new fee rule, a narrower licence for your content or a change to how accounts are closed. If you do not agree with a material change, close your account before its effective date. Using the service after that date means you accept the new version.
